Genuine students at London Metropolitan University are allowed to continue their studies after the High Court ruling 法院裁決倫敦城市大學的正規學生應可繼續他們的學業

The UK Border Agency (UKBA) faced a u-turn in its decision to suspendLondonMetropolitanUniversity’s (LMU) sponsor licence after a ruling by the High Court.
In August 2012, the UKBA suspended the University’s sponsor licence as the LMU had failed its responsibilities as a sponsor to recruit and teach foreign students. The ban by the UKBA led around 2,000 international students currently studying at the LMU to be faced with the threat of deportation or leave the country voluntarily. The students’ problems are compounded because their current visas would become invalidated and the students are required to find any alternative educational institute which can be their sponsors for the new student visas.
LMU immediately applied for a court ruling challenging the UKBA’s ban. The court ruled that the UKBA may have acted illegally by imposing a ban on LMU from teaching and recruiting foreign students. The court also made a temporary order to protect genuine students (who have full immigration status and are not in breach of immigration rules) that have been affected by the UKBA’s ban and gave LMU permission to mount a full legal challenge in the form of a judicial review.
The court said that UKBA’s ban is unfair on genuine students at LMU as they will be unable to continue their studies at LMU, particularly as many of the students are to begin the second or third year of their courses at the University.
The court ruling came as welcome news to the students at LMU. The UKBA insisted that the decision to suspend LMU’s licence is correct. The LMU still needs to be granted permission by the Court if it intends to continue recruiting non-EEA students.

在2012年8月，英國邊境管理局聲稱倫敦城市大學未遵守贊助人執照的責任及規定，因而吊銷倫敦城市大學的贊助人執照，禁止倫敦城市大學招募和教外國學生。英國邊境管理局的禁令，也導致就讀於倫敦城市大學的約2000名國際學生，必須被驅逐出境或自願離開英國，若使他們不能找到一個其它的教育機構，成為新學生簽證的贊助人。
倫敦城市大學立即向法院訴訟英國邊境管理局的禁令，法院裁定英國邊境管理局對倫敦城市大學有關教學和招收外國學生禁令，可能違法。法院也下令保護受影響的正規學生（持有合法簽證，並沒有違反移民規定），並允許倫敦城市大學對英國邊境管理局的禁令，以司法審查的形式向法院申請訴訟。
法官指出，英國邊境管理局的禁令，對倫敦城市大學的正規學生是不公平的，因為他們將無法繼續在倫敦城市大學的完成他們的學業，尤其很多學生即將開始他們在大學的第二年或第三年課程。
法院的判決對倫敦城市大學的學生無疑是個好消息。英國邊境管理局仍堅持，吊銷倫敦城市大學的贊助人執照的決定是正確的。 目前，倫敦城市大學正打算向法院申請，讓法院對於倫敦城市大學是否可招聘更多的非歐洲經濟區的學生，做出判決。
