Rules on family migration and the new income requirements 家庭遷移簽證的規則和新的收入要求

The UK Border Agency (UKBA) imposes strict rules in terms of the family visa where applicants will have to meet a myriad of requirements in their family relationship, their English language ability and their financial circumstances when applying for a visa to visit or stay in the UK. You should fill in your visa application on line, unless you are applying from some selected countries.
As the partner of a British citizen, or a person settled in the UK, or a person in the UK with refugees leave or humanitarian protection, you must show that
You and your partner are both aged 18 or over at the date of application;
Your partner is not related to you in a way that means you could not marry in UK law;
- You and your partner have met in person;
- Your relationship with your partner is genuine and subsisting;
- if you are married or in a civil partnership, your marriage or civil partnership is valid in UK law;
- You meet the suitability requirements;
- any previous relationship has permanently broken down
- You and your partner intend to live together permanently in the UK;
- You meet the financial requirement;
- You meet the English language requirement;
If you are in the UK and want to extend your leave or apply for settlement in the UK you will need to meet the suitability requirement.
English language requirement
To fulfill the requirement of English language, you must show one of the following evidence:
- are a national of a majority English-speaking country; or
- have passed an English language test approved by us at the appropriate level; or
- hold a degree that was taught in English and is equivalent to a UK bachelor’s degree or above.

Financial requirement
These new rules in respect of the income requirement apply to any visa applicant who submits the application from and including 9th July 2012.
You and/or your partner must have an income of at least £18,600 p.a. If you are bringing a child as well as a partner you will need an income of at least £22,400 p.a. For each additional child being sponsored you will need an additional income of £2,400. For example, if you are you are bringing 2 children with you to the United Kingdom, you must have and income of £22,400 p.a. and £2,400 for the additional child, so a total of £24,800 p.a.
You can meet the financial requirement through:
- The income from employment or self employment of your sponsor;
- The income from your employment or self employment if you are in the UK;
- Certain income from sources other than employment, such as rent from property;
- State or private pensions of you and your sponsor;
- Maternity allowances or bereavement benefits received in the UK; or
- Cash savings over a certain level (the amount of savings that you need to have will depend the level of other income that you and your sponsor have . If you are applying to enter the UK, you will need to have a higher level of savings than if you are applying to extend your stay).
List of documents for your application
- 2 recent passport photographs and your passport;
- Evidence of your age and your partner’s age;
- Your marriage or civil partnership certificate;
- Evidence that you were both free to marry or enter your civil partnership, if either of you was previously married or in a civil partnership;
- Evidence that you have met;
- Evidence of your English language ability;
- Evidence that you meet the financial requirement.
英國邊境管理局（UKBA）對於簽證申請人辦理家庭類別的家屬簽證十分嚴格，申請人必須滿足層層要求，尤其在於你和伴侶的家庭關係和財力情況，和你的英語語言能力，都需符合一定標準。除非你將從一些特定的國家申請，你應在網上填寫您的簽證申請。
以英國公民，或在英國定居的人，或英國難民的伴侶身分辦簽證，你必須證明以下要點:
- 你和你的伴侶在申請簽證時皆滿18歲;
- 按英國法律而言，你的伴侶和你是沒有親屬關係的，且該關係不能意味著你不能在英國結婚;
- 你和你的伴侶見過面;
- 你和你的伴侶關係是真實和存在的 ;
- 如果你是已婚或辦理過同性夥伴登記，該婚姻或同性登記關係在英國是合法有效的;
- 您滿足適用性要求 ;
- 以前的任何婚姻或同性夥伴關係是永久結束的;
- 你和你的伴侶打算在英國永久地生活;
- 您滿足財力要求;
- 您滿足英文水平要求;
- 假如你目前在英國打算申請您的簽證申請或是申請長期居留，您將需要滿足適用性要求。
英語語言要求
要符合英語語言條件，你必須出示下列證據：
- 身分為具有大部分講英語國家的國籍身分;
- 已經通過了適當的英語語言水平測試;
- 具有用英文教學的文憑且相當於英國的學士學位或以上。

財力要求
財力方面的新規則適用於2012年7月9日起申請簽證的申請人。
- 你和/或你的伴侶每年必須至少有£18,600的收入。
- 如果你已有一個孩子且要將孩子一起帶來英國，年收入至少要為£22,400。至於每增加一個孩子，你會需要額外年收入 £2,400。
- 如果你是將與你2個孩子到英國，你必須有年收入£22,400和 £2400贊助第二個孩子，所以年收入必須為 £24, 800。
你可以通過以下來證明你的財力需求：
- 你的配偶的薪資或是生意營利;
- 你的英國薪資或是生意營利;
- 非薪資來源的收入，例如租金收入或者;
- 私人養老金;
- 英國所給付的懷孕津貼或其他喪親津貼
- 英國公司發放的懷孕津貼或喪親補助;
- 現金儲蓄超過一定額度 ( 有關你儲蓄的金額要求，端視為你或你的伴侶在英國的收入為多少，如果您正要申請簽證入境英國，你就必須比申請延長居留提出較高的儲蓄）。
文件清單
- 2張近期護照照片和護照;
- 你的年齡和你的伴侶的年齡證明;
- 結婚證或同性夥伴關係證明書;
- 如果你們兩個其中一人結過婚，證明你們目前皆具自由結婚權力，
- 提供你和妳的伴侶見過面的證明;
- 你的英語語言能力的證明;
- 你滿足的財力需求證明。
