New student visa rules on language requirements and on the rights to work 學生簽證新規則: 語言要求和工作權利
From 7 December 2010 to 31 January 2011 the Government ran a public consultation on reform of the Tier 4 Student Immigration System, approximately 31,000 responses were received. On 22 March 2011, the Home Secretary Teresa May announced changes to students’ visas that will be enforced from July 2011.
English language requirements
- B2 in each of the four disciplines is the appropriate level for those coming to study at level 6 (undergraduate) and above.
- B1 is the appropriate level for lower courses, including the Pathways.
- In order to get a visa, universities will be able to vouch for a student’s ability where they are coming to study at degree level or above; whilst the rest of the education institutions will have to present a test certificate from an independent test provider, proving students have attained that level.
- UK Border Agency Officers will be able to refuse a migrant who cannot speak without an interpreter.
Restrictions on permission to work
- Students studying at a university will be able to work for 20 hours part time per week during term time.
- Students at public sector Further Education colleges will be able to work 10 hours per week during term time.
- Students at universities and at public sector FE colleges will be able to work full-time during the holidays.
No rights to work
For new students who make their student visa application after July 2011, studying in privately funded FE Colleges, languages schools, or independent schools will have NO right to work during term time or during holidays.
Work placements
- Students at Recognised Bodies (universities) will be able to undertake work placements where the study: work ratio is 50:50.
- For other students, work placements will have to be 66:33 in favour of study: work.
Dependants
- For a student to sponsor a dependant, the student will have to be on a post-graduate course (NQF 7 and above) at a university which is of more than 12 months’ duration, or a government sponsored student. (i.e in receipt of government sponsorship)
- The dependants will be able to work.
Changing sponsors
A new fee is being introduced for students who wish to change sponsors. This will be a charge of £160.
從 2010年12月7日2011年1月31日, 英國國境局展開對學生簽證的公眾諮詢,由大眾及學生們中共收到約 31,000名。在2011年3月22日,內政大臣Teresa May宣布學生簽證的更動內容,新規定從 2011年7月開始實行。
英語水平要求
- B2水平: 欲就讀大學及以上的科系
- B1水平: 欲就讀級別較低的課程,包括大學前的進修課程。
- 為了協助準學生取得簽證,大學可以擔保準學生有就讀大學及以上的英語能力,其他的教育機構則必須提出由獨立的語言機購提供的語言能力證明, 已證明學生有符何標準的英語水平。
- 英國邊境局人員將有權拒絕必須靠翻譯員溝通的準學生入境英國。
工作許可限制
- 大學生在學期內可每週兼職工作20小時。
- 國立教育學院的學生在學期內可每週工作10小時。
- 大學生學生和國立教育學院的學生在假期間可以全職工作。
在2011年7月後申請就讀私人教育學院,或英語語言學校或私立學校的學生,無論在學習期間或在假期間,都沒有工作權。
工作實習
- 大學生參與工作實習與在學校上課的比例可為 50:50。
- 對於其他學生,工作實習和學習比例為 33: 66 (學校課程要佔66%)
家屬
- 學生若要贊助家屬來英國,學生都必須為研究生(NQF 7及以上)而且課程超過 12個月的時間,或是政府的資助學生亦可。 (例如領取政府獎學金的學生)
- 家屬將能夠工作。
更改學校擔保人
如果學生有意更換學校, 將負擔160英鎊的費用。
